This privacy policy (this “Privacy Policy”) sets out how ELYSIS collects, maintains, uses, and discloses personal information. This Privacy Policy applies to the information we collected from you via our website www.elysis.com and any other places where, or means by which we may, collect personal information (the “Sites”).

This Privacy Policy also sets out how you can access certain information that ELYSIS may collect about you. In this Privacy Policy, “personal information” means any information relating to an individual that, directly or indirectly, allows such individual to be identified.

Please note that the Sites may contain links to other third-party websites that are not controlled or operated by ELYSIS. This Privacy Policy does not apply to such third-party websites, and ELYSIS is not responsible for the content of such third-party websites or the privacy practices of such third parties. Therefore, ELYSIS encourages you to request and review the privacy policies of any third parties before disclosing your personal information to such parties or when visiting such third-party websites.

CONSENT

By submitting personal information to ELYSIS or its service providers and agents, you agree that ELYSIS may collect your personal information and you consent to the use, disclosure and transfer of your personal information in accordance with the Privacy Policy and as permitted or required by law.  Subject to legal and contractual requirements, you may refuse or withdraw your consent to certain of the purposes identified herein at any time by contacting ELYSIS as set forth in the section below “How to contact us?” If you refuse or withdraw your consent, you acknowledge that ELYSIS may not be able to provide you or continue to provide you with certain services or information which may be of value to you.

UPDATES TO THIS PRIVACY POLICY

ELYSIS reserves the right to update this Privacy Policy at any time, without prior notice to you, unless otherwise required under applicable laws. It is your responsibility to check the Privacy Policy periodically for changes. All updates will be posted to the Sites and will apply to any personal information collected on or after the date posted.  ELYSIS will treat your continued use of the Sites following such updates as your acceptance of the revised terms. ELYSIS will obtain the necessary consents required under applicable privacy laws if it seeks to collect, use or disclose your personal information for purposes other than those to which consent has been obtained unless otherwise required or permitted by law. This Privacy Policy was last updated as of the effective date listed at the top.

HOW WE COLLECT YOUR INFORMATION

ELYSIS may collect personal information in connection with information you request or through your use of the Sites, which may include information you provide to us when:

  • Completing a request or submission to the Sites.
  • Requesting information or assistance from ELYSIS. ELYSIS may also keep a copy of any communications or correspondence you may send to it, including any email communications;
  • Participating or responding to consumer survey or requests for consumers’ opinions, concerns, and preferences regarding ELYSIS’s products and services; or when
  • Interacting with us by any other means (such as by email).

You hereby agree that the information you provide to ELYSIS is correct; otherwise, it is possible that we will be unable to provide you with products or services.

ELYSIS may also obtain information about you from other sources and combine that with information we collect directly from you.  We use this information to better understand your interests and for analytics purposes.

ELYSIS uses automated devices and applications provided by third parties, such as Google Analytics to collect technical information to evaluate usage of our Sites. We also may use other analytic means to evaluate our Sites.  These entities may use cookies and other tracking technologies which collect technical information to perform their services. We do not share personal information that we collect directly with these third parties. However, these third parties may collect personal information directly through the use of cookies and other tracking technologies, which may allow you to be identified, located, and profiled. You can prevent the collection of data concerning your use of the Sites (including your IP address), which are generated by the cookie, and the processing of that data by Google. HOW WE PROCESS PERSONAL INFORMATION PROVIDED OR OBTAINED THROUGH THE SITES

If you use the Sites, you may choose to provide personal information to ELYSIS LP (for example, by sending us an email). We will process the personal information that you provide through the Sites to answer your query and if relevant, to manage our business relationship with you or your company. If you choose to subscribe to our media releases or other communications, you can unsubscribe at any time (by following the instructions in the email or by contacting us at analytics@ELYSIS.com).

HOW WE USE YOUR PERSONAL INFOMATION

Upon ELYSIS’s collection of your personal information, ELYSIS may use such personal information internally, separately or in combination with pre-existing information, for the following purposes:

  • To contact you and to respond to any communications that you may have had with us;

  • To manage our business relationship with you or your company, when relevant;

  • To troubleshoot problems with the Sites;

  • To customize your experience or homepage on the Sites;

  • To develop and manage ELYSIS's business and operations;

  • To enforce ELYSIS’s Terms of Use or comply with this Privacy Policy;

  • To detect and protect ELYSIS and other third parties against error, negligence, breach of contract, fraud, theft and other illegal activity, and to audit compliance with ELYSIS’s policies and contractual obligations;

  • To protect the Sites, systems, information, employees, service providers, business partners, users, customers and others;

  • As permitted by, and/or to comply with, any legal or regulatory requirements or provisions;

  • To access, preserve, disclose and use your personal information contained in your submissions, all communications to and from you, all information relating to your use of the Sites, if ELYSIS is required to do so by law or legal process or if ELYSIS determines, in its sole discretion, that such action is necessary to protect the rights of ELYSIS, third parties, and other users of the Sites or for purposes of responding to your request for customer service; or

In addition, ELYSIS or its service providers and agents may aggregate the technical information collected to process and use it for various purposes including, but not limited to, analyzing this data for trends and statistics, developing the Sites and their features and offerings, assessing patterns of use, or planning and evaluating marketing initiatives. The technical information gathered is maintained, used and disclosed in aggregate form unless otherwise noted.

As ELYSIS is a limited partnership, we may share your personal information to our general partner, Investissement Québec, and our limited partners, 10676276 Canada Inc. and Light Metal Technologies ULC, as well as each of their respective subsidiaries or affiliates.

Service ProvidersWe may share your personal information to our subsidiaries or affiliates and to third parties whom we engage to provide services on our behalf, including services such as support, website hosting, marketing, data storage and answering customer inquiries about our products and services.  Some of these parties may be based or share your information outside of the province of Quebec. These entities, which may be located overseas, will only be provided with the personal information they require to deliver the services to us and/or on our behalf. We will not disclose your personal information to third parties for their direct marketing purposes without obtaining prior affirmative consent.
Professional Advisors

We may share your information to our legal, financial, insurance, accounting or other consultants to the extent necessary to operate our business, including proceeding with any business transactions as set out below, and complying with applicable laws.

Law Enforcement and Other authorities

We may receive requests by authorities to access your information. We will validate that the request is licit before responding. When possible, we will advise you. We will only share what is strictly required.

Commercial Transactions

We may share your information with an acquirer, successor or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets. In this context, this includes disclosure to any professional advisors necessary in connection with such business transaction.

You also consent to ELYSIS disclosing your personal information as consented to by you from time to time, including to fulfil any other purposes that are identified when the personal information is collected or as otherwise permitted or required by law.

HOW WE TRANSFER YOUR INFORMATION 

We operate mainly in Canada, but we may communicate, store, or process the information we collect from you within your home jurisdiction to jurisdictions other than your home jurisdiction, such as the United States, Canada or in Europe, for the purposes described in this policy. By submitting information to us, you consent to the communication of your information to, and the storage of that information, outside of your province of residence.  While such information is outside of your province of residence, it is subject to the laws of the jurisdiction in which it is held, and may be subject to disclosure to the government, courts, law enforcement, regulatory agencies and national security authorities of that jurisdiction pursuant to local laws. However, our practices regarding your information will continue to be governed by this Privacy Policy at all times. Where applicable, we comply with legal requirements providing adequate protection for the transfer of information to third countries, and any laws regarding the collection, use, sharing, and retention of personal information.

HOW WE PROTECT AND KEEP YOUR INFORMATION

We implement physical, administrative and technical safeguards designed to preserve the confidentiality, integrity and security of information under our control. However, information transmitted on the Internet and/or stored on systems attached to the Internet is not 100% secure, and no security can provide absolute protection. As a result, we do not ensure, warrant or guarantee the security or integrity of such information. You understand that any messages or information you send to the Sites may be read or intercepted by others. We retain your information only for as long as is necessary for us to fulfil the relevant purposes specified in this Privacy Policy and to comply with our legal obligations, in accordance with applicable laws.

CHILDREN’S PRIVACY

This Website is designed for and intended for use by adults. Persons under the age of 18 may use the Website only with the involvement of a parent or guardian.

If you are the parent or legal guardian of a child under 14 who has provided us with personal information, please contact us as set forth in the section below “How to contact us?” to ask us to stop using or to delete that information.

YOUR CHOICES AND OPT-OUT PREFERENCES

If, at any time, you wish to stop receiving email communications from us (except in connection with information, services that you specifically request), you can unsubscribe from such communications by using the unsubscribe link included in every email sent to you, or by contacting us at PrivacyOfficer-ELYSIS@elysis.com

YOUR LEGAL RIGHTS REGARDING YOUR INFORMATION

ELYSIS will take reasonable steps to ensure the personal information it holds is accurate, complete and up to date. Under certain circumstances and subject to applicable data protection laws, supported by a written request and proof of identification, you may consult the personal information that we have collected, used or shared, and/or ask that it be corrected, and/or withdraw your consent to our disclosure or use of personal information collected.

As required or permitted by law, you may be entitled to additional rights, including (i) the right to control the dissemination of your personal information; (ii) the right to receive computerized personal information collected from you in a structured, commonly used and technological format and to have this information transferred directly to another organization; (iii) the right to be informed of and submit observations regarding automated decision-making; and (iv) the right to request information about data processing.

Finally, you also have a right to lodge a complaint with a competent data protection authority, in particular in the country/territory where you normally reside, where we are based or where an alleged infringement of data protection law has taken place, such as the Commission d’accès à l’information du Québec.
